Throughout the site, the terms "we," "us," and "our" refer to Apricity Products LLC ("Apricity Products"). Apricity Products offers this website, including all information, tools, products, and services available from this site and from our physical store, to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here. By visiting our site, shopping with us online or in store, or purchasing something from us, you engage in our "Services" and agree to be bound by the following terms and conditions ("Terms of Service" or "Terms"), including the additional terms and policies referenced herein. These Terms of Service apply to all users of the site, including browsers, customers, vendors, and contributors of content. Our online store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products and services to you. SECTION 2 — OUR PRODUCTS Our candles are hand-poured using coconut and apricot wax with crackling wooden wicks, and our tie-dye apparel is individually hand-dyed. Because our goods are handmade, no two items are exactly alike. Slight variations in color, pattern, scent strength, wood grain, burn characteristics, and finish are natural features of handmade products and are not considered defects. We have made every effort to display the colors and images of our products as accurately as possible. We cannot guarantee that your device's display of any color will be accurate, and actual products may vary. All descriptions of products and product pricing are subject to change at any time without notice, in our sole discretion. We reserve the right to discontinue any product at any time. Because many of our items, including our one-of-a-kind tie-dye pieces, are made in very limited quantities, availability is not guaranteed and items may sell out. SECTION 3 — CANDLE SAFETY AND PRODUCT CARE Our candles and home fragrance products are intended to be used responsibly and in accordance with all safety and care instructions provided with the product or on our website. You are solely responsible for following these instructions, including never leaving a burning candle unattended, keeping candles away from children, pets, and flammable materials, trimming wicks as directed, and discontinuing use when appropriate. To the fullest extent permitted by law, Apricity Products is not liable for any damage, injury, or loss resulting from the misuse of our candles or other products, or from a failure to follow the provided safety and care instructions. SECTION 4 — ORDERS, PRICING, AND PAYMENT We reserve the right to refuse or cancel any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. If we make a change to or cancel an order, we will attempt to notify you using the contact information provided at the time the order was placed. Prices for our products are shown in U.S. dollars and are subject to change. Occasionally there may be information on our site that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, or availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate, at any time without prior notice, including after you have submitted your order. You agree to provide current, complete, and accurate purchase and account information for all purchases, and to promptly update your information so we can complete your transactions and contact you as needed. Applicable sales tax will be added to orders as required by law. SECTION 5 — SHIPPING, RETURNS, AND EXCHANGES We currently sell and ship within the United States only. Shipping timeframes, costs, and methods are described in our Shipping Policy. Returns, exchanges, and refunds are governed by our Return and Refund Policy. Please review those policies, which are incorporated into these Terms by reference. Because our tie-dye pieces are one-of-a-kind and many of our items are handmade, some products may be final sale as described in our Return and Refund Policy. SECTION 6 — IN-STORE PURCHASES, WORKSHOPS, AND THE CANDLE BAR In addition to online sales, we operate a physical store and offer experiences including our walk-in candle bar, workshops, and events. Tickets, bookings, and reservations for these experiences are subject to availability and to any additional terms, scheduling, and cancellation policies stated at the time of purchase. You are responsible for following all posted safety instructions and staff guidance while participating in any in-store experience. SECTION 7 — LOCAL MAKER AND VENDOR GOODS Some products offered through our store and in our physical location are created by independent local artisans and vendors. While we are proud to feature their work, these goods are made by third parties. Except as required by law, we make no representations or warranties regarding vendor-made goods beyond any warranty or representation provided by the individual maker.
